UK National Lottery License Transfers From Camelot to Allwyn Entertainment

After 28 years with Camelot, the UK National Lottery license is changing hands. Allwyn Entertainment now has a 10-year deal to run the lottery, and the transition has already started.  A New Home for the National Lottery  The UK Gambling Commission has entered into an enabling agreement with Allwyn to ensure a smooth transition from Camelot.  A few changes are expected, and these will improve the customer experience, while the licensee perspective is also set for a shake-up. The operator incentive mechanism will change to better align with returns for good causes, while a retail charter and greater flexibility for the license holder will also feature in the new agreement.  A Contested Handover The switch to Allwyn has been contested by Camelot, which has held the license since the UK National Lottery launched in 1994. Along with IGT, their technology partner, Camelot challenged the handover in court, claiming the UKGC did not provide a proper explanation for the change in operator.   The High Court automatically suspended the decision, but Camelot withdrew the action in September, not wanting a lengthy legal fight to affect money for good causes. “We are pleased to have officially awarded the fourth licence to Allwyn following a highly successful competition and the court’s decision to lift the suspension on the award process,” said Commission CEO Andrew Rhodes. “We now look forward to working with all parties to ensure a smooth and efficient handover.'' BetFred Fine Really Does Teach a Lesson: Hopefully UK Operators Learn It

The UK Gambling Commission has laid a substantial fine on UK giant operator BetFred. Fine Recipient Parent company Petfre Limited took the blow. The owner of Betfred and Oddsking.com was fined £2.8m by the GB Gambling Commission for a series of social responsibility and anti-money laundering (AML) failures that took place between October 2019 and December 2020. Code Violations Petfre was found in violation of section 121 of the 2005 Gambling Act, with an additional warning issued under section 117(1)(a). Passive Violation A lack of action stands out in the violations. The most inciting incident is the Betfred customer who lost £70,000 within ten hours of opening their account.  Insufficient Response A lack of sufficient response is visible in another incident where a customer was contacted by the operator after a £20,700 incurred a prompt £10,200 loss. This problematic behavior was not intervened with again by BetFred until four months later when the same customer deposited £323,715 and lost £69,371. Customer Interaction Failures The Commission found Petfre parent company in violation of paragraphs 1 and 2 of the social responsibility code of practice addressing customer interactions. Policy and Procedure Breakdowns The Commission found specific fault with what it deemed failures in Petfre’s policy and procedures to combat AML and terrorist financing risks. Breakpoints Specific points of failure identified by the commission include gaps in employee training, transaction analysis, insufficient AML, customer due diligence, and source of funds checks, along with further insufficient implementation and enforcement.   Commission Spokesperson Speaks Gambling Commission director of enforcement and intelligence Leanne Oxley called the fine an example of her organisation “taking action to investigate and sanction alarming failures.” All Operators Should Note Oxley urged Petfre and all licensed operators “to review this case and look closely to see if they need to make further improvements to demonstrate active compliance.” Improve the Status Quo Oxley chided the industry overall, promising “tougher enforcement” if standards do not come up. Other Recent Fines The Betfred example is not the first warning to major operators in the UK. Just last week, leading bet operator Betway got slapped with a £400,000 fine for allowing the Betay logo to appear as children’s content--on a West Ham web page which contained a colouring-in activity. Other operators penalised recently to varying extents include Smarkets, Entain, and SpreadEx. Outlook Along with the other recent fines, the Betfred serves as the Commission’s wake-up call asserting that the current status quo is not satisfactory. Operation in the UK requires operators to be proactive in maintaining full accountability for how their marketing messages appear on the front end.

New Penalty Handed Down by Great Britain Commission Outlines Scope of Operator Accountability

A penalty from UKGC once again illustrates the need to understand and process self-exclusion guidelines. The Penalty Gambling operator NSUS Limited has taken the hit from UKGC to the tune of £672,829 penalty for social responsibility and anti-money laundering failures, with the penalties more clearly illustrating the scope of accountability that an increasingly active UKGC is going to hold operators to. Added Warning Trading as GGPoker and operating as www.ggpoker.co.uk, NSUS is also absorbing an official warning for the failures. The Violations Failures include the inability to identify customers at risk of experiencing gambling-related harm; and failing to interact with customers identified at risk of experiencing gambling-related harm. Full Obligations The Commission expanded on the requirements of operators in the NSUS example by adding the preventative nature of operators’ obligations when NSUS failed to control their email marketing. Marketing Responsibility The Commission cited NSUS’ failure to “take all reasonable steps” to prevent certain materials from being sent to customers who had previously excluded themselves. The violation was in the emails, with 125 being sent to self-excluded customers. Managing Information Clearly, when customers self-exclude, operators need to take measures to control email and all other marketing materials as well, to the extent that they determine whether what they are sending out will continue to tempt customers to play. Editing or selecting marketing materials to be sent to specific customers seems like a reasonable obligation for operators to integrate to continue operating seamlessly and proactively. Controlling Information This is also a more prominent reminder of the need for operators to be aware of the materials they are sending out. AML Check Violations Further anti-money laundering violations identified by the Commission on the part of NSUS include failures to conduct adequate anti-money laundering and terrorist financing assessments, risk assessments and failures to ensure the positioning of appropriate policies, procedures, and controls to prevent money laundering and terrorist financing. Proactively Following Guidelines This penalty constitutes a solid reminder to operators to be proactive in understanding and addressing financial security checks and guidelines and reviewing the guidelines regularly. Stay in Touch It appears operators would benefit by staying in communication with the commission and consulting with them on the language in question, new guidelines, or applications of policy. Outlook Self-exclusion lists are tools used by players who have recognised that their gambling habits are harmful to them, and need help controlling them. The latest Commission penalties indicate how lists are only the beginning of the requirement, and operators must subsequently adapt their entire marketing approach organisation-wide.

The Gambling Act white paper is back. Publication Timeline According to iGB, this means that publication will move forward, to be published in the next few weeks to clear up previous rumours that the document could be pushed back to next year or shelved entirely which brought the white paper back into the spotlight in the first place. Delays An initial consultation almost two years ago was followed by numerous subsequent delays connected to personnel changes in government and at the UK Commission brought about the need for industry clarification. Resignations After originally being prepared for publication in July, changes such as the resignation of the minister responsible for the review Chris Philp, the resignation of former British PM Boris Johnson, and the transfer of responsibility for the document to new British Prime Minister Liz Truss all contributed to a new publication date.  Truss Issue The elevation of Truss to the top spot created new concerns about the future, with an article in The Guardian claiming that the Gambling Act could be among several regulatory policies to be eliminated by the Truss government.  Long Estimates Last week the Daily Mail published contents from DCMS Minister Michelle Donelan suggesting the review could be pushed back until 2023, with Betting and Gaming Council chief executive Michael Dugher estimating the review could take place by Christmas.   Confirming at Close Range Now iGB has indicated the new proximity of publication, indicating the release of the Gambling Act white paper could take place within weeks, and the iGB source calling any notion of delay “misleading."
